Please read the following terms and conditions carefully before you submit your application. They set out who we are, how your application is assessed and how any loan you are offered will work. You should keep a copy for your records.
Please read these business loan terms and conditions carefully before submitting this application. They set out who we are, the parties to the agreement, the authority needed to apply for a business, how the application and any loan are assessed, administered and repaid, and the obligations that apply to the business and to the signatory. Submitting the application means the business and the signatory accept these terms. Please keep a copy for your records.
Who we are and what these terms cover
These terms, together with our privacy notice and any other documents we provide to you, govern your use of this website and the loan application process. References to “we”, “us” or “our” mean the lending service operating this website, and references to “you” or “your” mean the person submitting an application on behalf of themselves. These terms do not give any rights to any third party.
The application process
By completing and submitting an application you are requesting that we assess whether to offer you a loan. An application is not a loan and does not oblige us to lend. We will review the information you provide, may ask you for further details or documents, and will take each application on its own merits. Any decision to approve, reject or hold an application is made entirely at our discretion.
Eligibility
To be eligible to apply you must (a) be at least 18 years of age, (b) provide accurate, current and complete personal, contact and financial information, (c) hold a valid email address and telephone number that we can use to reach you, and (d) use the loan for a lawful purpose. We may apply additional criteria and may decline an application for any lawful reason, including where we cannot verify your identity or your ability to repay.
Accuracy of information and your responsibilities
You confirm that all information, documents and representations you provide in connection with your application and any loan are true, accurate and not misleading, and you agree to tell us promptly if any of that information changes. Withholding, misrepresenting or failing to disclose relevant information may invalidate any approval or loan and may result in the full balance becoming due. You are responsible for ensuring that the bank, payment and contact details you provide are current and correct.
Income, affordability and creditworthiness
Your reported income, expenses and other financial commitments are used to assess whether a loan is affordable for you. You agree to provide a truthful account of your financial situation and to notify us of any material change. We may verify income and other information through the documents you provide and, where permitted, other lawful means. An offer may be withdrawn or declined if we reasonably believe a loan is not affordable or appropriate for you.
Loan amount, term and interest
The amount, repayment term and nominal annual interest rate applicable to a loan are set out in your quote and confirmed in the loan agreement offered at approval. Interest is calculated on the reducing (outstanding) balance of the loan. All figures shown before approval, including the live quote and any calculator, are illustrative estimates only and are not a binding offer of credit.
Offer, acceptance and disbursement
If we approve your application we will make you an offer that sets out the exact amount, term, interest rate, installment and any fees. An agreement is formed only when you accept that offer in the way we instruct you. Following acceptance, and once any outstanding conditions (including document verification) are satisfied, we will arrange disbursement to the account you provide. We are not liable for delays caused by you or by third parties involved in transferring the funds.
Repayment
You agree to repay the principal, interest and any agreed fees in equal monthly installments as shown in your repayment schedule. Each installment is due in full on its scheduled due date and must be paid in the currency of the loan. Payment is your responsibility even if you do not receive a reminder, statement or notice. Where permitted, partial or misallocated payments will be applied in a fair and transparent order, in line with your repayment schedule.
Fees and charges
All applicable fees, including any administration, documentation or late fees, are disclosed to you in writing before you accept an offer and again in your loan agreement. We will not charge any fee you have not agreed to in writing. Late fees, where applicable, are applied only where an installment is overdue and in accordance with the agreed terms and applicable law. There are no hidden charges.
Early repayment and settlement
You may repay the full outstanding balance before the end of the term at any time. Where you settle early, the interest owed is recalculated fairly based on the remaining principal and the time the amount is outstanding, so you are not charged interest for periods after settlement. We may outline any applicable settlement process or cut-off times so that your payment is applied correctly.
Late payment and delinquency
If an installment is not paid in full by its due date, your loan may be recorded as overdue and any applicable late fee may be added. We may contact you using the details you have provided to discuss how to bring your account up to date and, where appropriate, may agree a revised arrangement. Failing to reach a satisfactory arrangement may affect your ability to obtain credit in future and may lead to the balance becoming due as described below.
Default and acceleration
We may treat a loan as being in default and make the full outstanding balance immediately due and payable if you fail to make payments when due and do not remedy the shortfall within a reasonable period, provide false or misleading information, become unable to repay, or otherwise breach a material term of your loan agreement. In the event of default we may recover the amount owed using any lawful means and may restrict access to your account.
Verification and documents
You agree to complete your document checklist and to provide the identity, income, residency and other documents we request, in the format we specify. We may use the documents and associated information to verify your identity and financial circumstances and to prevent fraud. Approval, disbursement and continued management of your loan depend on successful verification and on you responding to reasonable and timely requests for information.
Personal data and privacy
We collect and process your personal and financial information to assess, administer, service, collect and enforce your application and any loan, to provide our services, to detect and prevent fraud, and to meet our legal and regulatory obligations. We share your information only where necessary to provide the service or where the law requires it. Details of how we use, store and protect your data are set out in our privacy notice, which forms part of these terms.
Security and your credentials
You are responsible for the security and confidentiality of your account credentials, verification codes and any one-time passwords. You must not share them with anyone. You may be responsible for activity that takes place through your account where that results from your failure to keep your credentials secure. Please contact us immediately if you believe your account has been compromised.
Communication
You agree that we may communicate with you by email, telephone, text message or through your secured account portal for purposes related to your application and any loan, including service messages, reminders, statements, notices of changes and updates. You agree to keep your contact details up to date. Standard messaging and data charges may apply depending on your own service provider.
Withdrawing or cancelling your application
You may withdraw an application at any time before it is accepted by contacting us or using the tools in your account. After acceptance, any right to cancel the resulting credit agreement will be as described in your loan documents and as provided by applicable law. Where you withdraw or cancel, any applicable process and any effect on fees or charges will be set out in your loan documents.
Complaints
If you are unhappy with any aspect of our service, we encourage you to contact us so that we can resolve the matter. We will acknowledge reasonable complaints promptly and handle them fairly and without delay. Nothing in these terms limits your right to take any action available to you under applicable law.
Changes to these terms
We may update these terms from time to time to reflect changes in our products, our processes or legal requirements. Where we make material changes we will take reasonable steps to bring them to your attention before they take effect. Your continued use of your account, or the acceptance of a new loan after a change takes effect, constitutes acceptance of the updated terms.
General provisions
If any part of these terms is held to be invalid or unenforceable, the remainder continues to apply. Our failure to enforce any provision is not a waiver of it. You may not transfer any rights or obligations under a loan without our prior written agreement, and we may transfer or assign our rights and obligations subject to applicable law. These terms, together with your loan documents and our privacy notice, set out the entire agreement between us in respect of your application and any loan.
Who we are, the parties and what these business terms cover
These business terms govern the business loan application and any business loan we provide. References to “we”, “us” and “our” mean the lending service operating this website. References to “the business” mean the entity named in the application, whether a sole trader, partnership, limited liability company, corporation, non-profit or any other legally recognised organisation. References to “the signatory” mean the individual who submits the application for and on behalf of the business. References to “you” mean the business and, where the context requires, the signatory. References to “the loan documents” mean the offer, the loan agreement, the repayment schedule and any security, guarantee or related document we issue. These terms apply alongside our privacy notice and the loan documents, and give no rights to anyone who is not a party to them.
The business loan application process
By completing and submitting this application, the business is asking us to assess whether to offer it a loan. An application is a request only: it is not an offer, a promise, a commitment or a loan, and it does not oblige us to lend. We will review the information and documents supplied, may request further information or supporting evidence, may carry out our own checks, and will assess each application on its own merits. Any decision to approve, decline, hold, condition or vary an application, or to offer terms different from those illustrated, is made at our discretion and for lawful reasons. The live quote and any calculator output are illustrative estimates only and are not a binding offer of credit.
Authority to apply and to bind the business
The signatory confirms and warrants that they are a director, partner, owner, officer, trustee or other duly authorised representative of the business; that they are authorised to submit this application, to give the information and confirmations in it, to receive information about it, and to accept these terms and any resulting loan agreement on the business’s behalf; and that they are at least 18 years old. We may require evidence of the signatory’s identity, position and authority, a board, partnership or equivalent resolution, or confirmation from another authorised person before we proceed, and we may rely on the signatory’s signature and confirmations without further inquiry. The business is responsible for the acts and omissions of everyone who submits, accesses or administers the application or account on its behalf.
Eligibility, legal standing and permitted purpose
To be eligible, the business must be properly constituted and validly existing under the laws that apply to it; must have full power and authority to carry on its activities, to borrow, and to enter into and perform a loan; must not be insolvent or subject to proceedings that could lead to insolvency; must be applying for a lawful business purpose; and must be able to repay the amounts it borrows. We may apply additional eligibility criteria, which we may change from time to time. We may decline an application for any lawful reason, including where we cannot verify the business, its legal form, its ownership or control, the signatory’s identity or authority, or the business’s ability to repay.
Accuracy, completeness and disclosure of information
The business and the signatory confirm that all information, documents, statements and representations provided in connection with the application and any loan are true, complete, accurate and not misleading, and that nothing material has been withheld, including anything about the business’s ownership, control, finances, liabilities, legal proceedings or change in circumstances. You agree to tell us promptly if any of that information changes or turns out to be inaccurate, incomplete or misleading. Withholding information, or giving false, incomplete or misleading information, may invalidate an approval, cause an offer to be withdrawn or cancelled, entitle us to demand immediate repayment of the full outstanding balance, and may amount to a criminal offence. We may rely on the information you provide without independently verifying all of it.
Financial information, trading history and affordability
The business agrees to give a truthful, complete and up-to-date account of its financial position, trading history, revenue, profitability, existing borrowing, commitments, assets and liabilities, and any other information we reasonably require to assess affordability and creditworthiness. You agree to provide the financial statements, management accounts, bank statements, tax records or other supporting evidence we request, and to notify us promptly of any material deterioration in the business’s financial position or prospects. Where permitted, we may verify this information with third parties and by other lawful means. We may decline or withdraw an offer, or change the terms offered, if we reasonably believe a loan is not affordable, adequately supported or appropriate for the business.
Identity, ownership and control, and anti-financial-crime checks
You agree that we may carry out, and may ask third parties to carry out, identity and business verification checks on the business and on individuals connected with it, including the signatory, directors, partners, owners, beneficial owners and persons with control; sanctions, politically-exposed-person and adverse-media screening; and other checks we consider necessary to meet our legal and regulatory obligations or to prevent and detect fraud, money laundering and terrorist financing. You agree to provide the information and documents we reasonably require for those checks, in the format and within the time we specify. We may decline, suspend or end an application, withhold or delay disbursement, or take other lawful steps if a check cannot be completed satisfactorily, if information cannot be verified, or if a check raises a concern.
Beneficial owners, controllers and connected persons
The business confirms that the information it provides about its legal structure, ownership, control, directors, partners, shareholders and beneficial owners is complete and accurate, and that the individuals named are the true beneficial owners and controllers. The business agrees to identify, on request, any person who directly or indirectly owns or controls it, any person on whose behalf the loan is being obtained, and any person connected with the business whose information is required for our checks. Where the business acts for or on behalf of another person, it confirms that it is authorised to do so and to share that person’s information with us to the extent permitted by law, and it will help us obtain any consent or confirmation we need.
Use of loan proceeds and prohibited activities
The loan must be used only for the lawful business purpose described in the application, or for another lawful business purpose we agree in writing in advance. The proceeds must not be used for any illegal, fraudulent, deceptive, sanctioned, terrorist-financing, money-laundering, tax-evasion or otherwise prohibited activity; to acquire or fund anything unlawful; or for personal, household, consumer or non-business purposes, unless we have agreed that in writing. The business must not on-lend the proceeds, use them to repay related-party debt where that would defeat the purpose of the loan, or apply them in a way that misrepresents their origin or destination. We may require reasonable evidence of how the proceeds were used, and may treat a breach of this clause as a material breach.
Loan amount, term, interest and repayment basis
The amount, term and nominal annual interest rate for any loan are those set out in the offer and confirmed in the loan agreement. The term is expressed in whole months, and repayment is due in equal monthly installments on a fixed monthly cadence. Interest is calculated on the reducing (outstanding) balance from the date of disbursement and is included in each installment. Any rounding difference is absorbed by the final installment so that the installments reconcile to the amount due. Figures shown before an offer is accepted, including the live quote and any calculator on this website, are illustrative estimates based on the information available at the time and are not a binding offer of credit. A change in the amount, term or rate requested by the business is subject to our agreement and may require a new or amended offer.
Fees, charges, costs and taxes
Any arrangement, administration, documentation, late-payment or other fees and charges that apply to a loan are disclosed in the offer and in the loan documents before acceptance, together with whether they are payable upfront or financed into the installments. We will not apply a fee that has not been disclosed to you and agreed in writing. Where the loan documents permit, we may also recover reasonable costs we incur because the business fails to meet its obligations, because we have to take steps to recover amounts due, or because the business asks us to change the loan. The business is responsible for any taxes, duties, levies and reporting obligations arising in connection with the loan or its use of the proceeds, other than taxes on our own income, and for keeping its own accounting and tax records. Amounts we quote may be exclusive of any taxes for which the business is responsible.
Offer, acceptance and formation of the agreement
If we approve the application, we will make the business an offer setting out the amount, term, interest rate, repayment schedule, fees, conditions and any security or guarantee requirements. No agreement is formed until an offer has been accepted by a person authorised to bind the business, in the manner we instruct, and any conditions we set have been satisfied. The business may not rely on an offer that has lapsed, been withdrawn or been varied. We may withdraw or vary an offer before acceptance if our assessment changes, if new information comes to light, if a condition cannot be met, or if the law requires it. Once an offer is accepted, the accepted terms and the loan documents form the agreement between the business and us.
Conditions to disbursement and the funding account
We will disburse a loan only after the offer has been accepted, all conditions to disbursement have been satisfied, the required documents have been provided and verified, and the funding account for the loan has been completed to our satisfaction. The funding account is captured for each individual loan at the point of acceptance and is not stored on the business’s profile; it must be an account the business is entitled to receive funds into, and the details must be accurate and complete. We may decline to disburse, or may delay disbursement, while verification, checks or conditions remain outstanding. We are not responsible for delays or losses caused by incorrect, incomplete or unauthorised account details, by the business, or by banks or other third parties involved in transferring the funds.
Repayment, installments, currency and allocation of payments
The business agrees to repay the principal, interest, any financed fees and any other amounts due in the amounts and on the dates shown in the repayment schedule until the loan is repaid in full. Each installment is due in full on its due date and must be paid in the currency of the loan. Repayment is the business’s responsibility whether or not it receives a reminder, statement or notice, and regardless of any internal dispute, change of personnel or difficulty in accessing the portal. Payments are applied to the earliest unpaid installment. Where a payment is less than the amount due, it is applied first to interest, then to any financed or other fees, and then to principal, and the installment remains partly unpaid; allocations may be adjusted to correct errors or to reflect the actual date and amount of a payment.
Overpayments, part-payments and early settlement
The business may make part-payments or overpayments at any time. An overpayment reduces the outstanding principal and may reduce the interest that would otherwise accrue on it, but does not by itself discharge future installments or alter the repayment schedule unless we agree. The business may repay a loan in full early by requesting a settlement figure. Where a loan is settled early, interest is recalculated to the settlement date on the reducing balance outstanding so that interest is not charged for periods after settlement, and any financed fees that have not been earned are treated as set out in the loan documents. A settlement is effective only when the settlement amount has been received in full by the method and by any cut-off time we specify, and we may need to confirm cleared funds before the loan is recorded as settled.
Late payment and delinquency
If all or part of an installment is not paid by its due date, the loan becomes overdue and the unpaid amount remains payable. We may contact the business and the signatory using the contact details we hold to discuss the position and agree a way forward, and we may record the overdue position on the account. Late-payment charges, where the loan documents permit them, may be applied to an overdue installment. Ongoing non-payment may affect the business’s and the signatory’s ability to obtain credit in future and may lead to the steps described in the next clause. The business must tell us promptly if it expects to miss a payment or if its ability to pay is affected.
Default, acceleration and enforcement
We may treat a loan as being in default, and require immediate repayment of the full outstanding balance together with accrued interest, fees and costs, if: the business fails to pay any amount when due and does not remedy the position within any period allowed by the loan documents; the business or the signatory provides false, misleading or materially incomplete information; the business becomes unable to pay its debts as they fall due, ceases or threatens to cease trading, or becomes subject to insolvency, administration, receivership, liquidation or analogous proceedings; the business breaches a material term of these terms or the loan documents; a security, guarantee or other credit support is not provided, lapses or becomes unenforceable; or any other event occurs that we reasonably consider materially impairs the business’s ability to perform or our ability to recover. On default we may take any lawful steps to recover the amounts due, may report the position to credit-reference, fraud-prevention or regulatory bodies where the law allows, and may suspend access to the portal.
Security, guarantees, indemnities and set-off
Unless the offer states otherwise, a business loan is unsecured and no guarantee or collateral is required. If the offer does require security, a guarantee or another form of credit support, those arrangements will be documented separately, must be completed and in place before disbursement, and will be enforceable in accordance with their own terms; the business must ensure the relevant parties cooperate and provide full and accurate information. To the extent permitted by applicable law, we may set off any amount the business owes us against any amount we owe the business, and may apply any credit balance, deposit or recovery towards amounts due under the loan. The business will reimburse us for reasonable costs and expenses incurred in protecting or enforcing our rights, where the loan documents provide for this.
Ongoing information and financial undertakings
For as long as any amount remains outstanding, the business agrees to keep proper books and records; to provide us, promptly on request, with the financial and other information we reasonably require, including annual or periodic accounts and details of material changes; to tell us promptly about any material adverse change in its business, financial position, prospects or ability to repay; to comply with the laws that apply to it and maintain the licences, permits and registrations needed for its activities; and to comply with any specific undertakings or covenants set out in the offer or the loan documents. Where the business is part of a group, it agrees to provide information about the group to the extent reasonably needed to assess or monitor the loan.
Changes in the business, ownership, control and insolvency
The business agrees to tell us promptly about any change or proposed change that may affect the loan or our ability to recover it, including a change of name, legal form or status; a change in ownership or control; a merger, acquisition, reorganisation, restructuring or material disposal of assets; a decision to cease or suspend trading, sell the business, or enter into any insolvency, administration, receivership, liquidation or analogous process; the appointment of a receiver, administrator, trustee or similar officer; and any material legal proceedings, investigation, sanction or dispute. Without our prior written agreement, the business must not do anything that would transfer or dilute our rights or materially reduce its ability to repay. Where the loan documents permit, a failure to notify us, or the occurrence of one of these events, may be treated as a breach and may entitle us to demand immediate repayment.
Records, cooperation and audit
The business agrees to keep accurate records of the loan and of how the proceeds were used for a reasonable period, and to allow us, on reasonable notice and during reasonable hours, to review or receive copies of those records or other information we reasonably require in order to monitor the loan, meet our legal and regulatory obligations, or investigate a suspected breach, fraud or financial-crime concern. The business agrees to cooperate promptly and in good faith with our reasonable requests and with any lawful investigation or request for information from a court, regulator or law-enforcement body. Nothing in this clause requires the business to disclose information it is legally prohibited from disclosing, provided it tells us that it is unable to comply and why, to the extent the law allows.
Portal access, authorised users and account security
The business will be given access to a secured portal through which it can manage the application and loan. The business is responsible for deciding who within the business is authorised to use the portal, for telling us promptly when that authority changes, and for all activity carried out through its account, including by its personnel or agents. Credentials, verification codes and one-time passwords must be kept confidential, must not be shared beyond the authorisation the business has granted, and must be protected against unauthorised access. The business must tell us immediately if it believes an account, credential or device has been compromised, lost, misused or accessed without authority. We may suspend or withdraw portal access where we reasonably believe there is a security risk, a breach of these terms, or a legal or regulatory requirement to do so.
Sanctions, prohibited persons and financial-crime compliance
The business and the signatory confirm that neither the business, nor any of its owners, controllers, directors, officers, partners or personnel, is a person or entity that is the subject of sanctions, is owned or controlled by a sanctioned person, or is otherwise prohibited from entering into a loan of this kind, and that no aspect of the application or the loan contravenes applicable sanctions, anti-money-laundering, anti-bribery, counter-terrorist-financing or anti-fraud laws. The business agrees not to use the proceeds in a way that would breach those laws, and to give us any information we reasonably need to comply with them. If this confirmation becomes untrue, or if we reasonably suspect a breach or a financial-crime concern, we may suspend or end the application, withhold disbursement, demand immediate repayment, and take any other lawful steps, including reporting the matter to the relevant authorities.
Data protection and privacy
We collect and process personal data about individuals connected with the business, including the signatory, directors, partners, owners and beneficial owners, as well as information about the business itself, in order to assess, administer, service, collect and enforce the application and any loan, to provide the service, to prevent and detect fraud and financial crime, and to meet our legal and regulatory obligations. We share that information only where necessary to provide the service, where the law permits or requires it, or with our professional advisers and service providers under appropriate obligations. Our privacy notice explains what we collect, why, how long we keep it, who we share it with and the rights available to individuals, and forms part of these terms. The business must ensure that individuals whose information it gives to us are made aware of our privacy notice and of how their data will be used, to the extent the law requires.
Confidentiality and publicity
Each party will keep confidential the non-public information it receives about the other in connection with the application and any loan, will use it only for the purposes of the application and the loan, and will protect it with at least a reasonable degree of care. This obligation does not apply to information that is or becomes public without breach, that the receiving party already lawfully held, or that must be disclosed by law, by a court, by a regulator, or to a professional adviser, auditor or service provider under a duty of confidence. Neither party may use the other’s name, logo or trademarks in a public statement, press release, case study or marketing material without the other’s prior written consent, except where disclosure is required by law or by a regulator.
Communications and notices
You agree that we may communicate with the business and the signatory by email, telephone, text message, post or through the secured portal in connection with the application and any loan, including service messages, payment reminders, statements, notices of changes and other information. Communications and notices sent to the most recent contact details the business or the signatory has given us are treated as received by the business when sent, and the business must keep those details accurate, complete and up to date. The business agrees to check the portal and its registered contact details periodically. Standard messaging, data or postal charges applied by your own providers are your responsibility. Where the loan documents require a particular form of notice, that requirement applies in addition to this clause.
Withdrawing, cancelling or declining an application
The business may withdraw the application at any time before an offer is accepted by contacting us or using the tools in the portal; where an account has already been created, withdrawing an application does not by itself close the account or delete records we are obliged to keep. We may decline, suspend or withdraw an application or an offer at any time before acceptance, for any lawful reason, including where information cannot be verified, a condition is not met, or a check raises a concern. After the business has accepted an offer, any right to cancel the resulting agreement, and the consequences of cancellation, are as set out in the loan documents and as provided by applicable law. Withdrawal or cancellation does not affect any liability that has already arisen or any right to sums properly due at that time.
Complaints and disputes
If the business is unhappy with any aspect of our service, it should contact us first so that we can try to resolve the matter. We will acknowledge reasonable complaints promptly, investigate them fairly and without undue delay, keep the business informed of progress, and explain the outcome in writing. If a complaint cannot be resolved between us, the business may use any alternative dispute-resolution process identified in the loan documents or available under applicable law, and nothing in these terms prevents either party from seeking a remedy from a court or other authority with jurisdiction. The business and the signatory agree to raise concerns with us before taking public or third-party action that could affect the other’s reputation.
Changes to these terms, assignment and transfer
We may update these terms from time to time to reflect changes in our products, processes, pricing structure, technology or legal and regulatory requirements. Where a change is material and affects an existing loan or an application, we will take reasonable steps to bring it to your attention before it takes effect; changes required by law may take effect immediately. The business may not transfer, assign or otherwise deal with its rights or obligations under the application or any loan without our prior written agreement. We may transfer, assign, novate or otherwise deal with our rights and obligations, or appoint a third party to administer or collect a loan, subject to applicable law and without reducing the business’s rights under the loan documents. We may share information with a prospective or actual transferee, assignee or servicer subject to appropriate confidentiality.
Relationship with the loan documents and entire agreement
These terms apply alongside the loan documents and do not replace them. If an offer, loan agreement, security document or other loan document conflicts with these terms, the loan document prevails to the extent of the conflict in relation to that loan. The application, these terms, our privacy notice and the loan documents together record the entire agreement between the business and us in respect of the application and any loan, and supersede any earlier or contemporaneous understanding, representation or arrangement on the same subject. No representation, statement or illustration made before an offer is accepted forms part of the agreement unless it is repeated in the loan documents, and nothing in these terms excludes any liability that cannot lawfully be excluded.
General provisions
If any provision of these terms is found to be invalid, illegal or unenforceable, that provision is severed and the remaining provisions continue in full force. Our failure or delay in enforcing any provision is not a waiver of it, and no single or partial exercise of a right prevents any further exercise. Rights and remedies under these terms and the loan documents are cumulative and not exclusive of any rights or remedies provided by law. Nothing in these terms creates a partnership, agency, joint venture or employment relationship between the business and us, and the business has no authority to act for us. A person who is not a party to these terms has no right to enforce them, except for a transferee or assignee of our rights. These terms survive the end of the application and the repayment or settlement of any loan to the extent necessary to give effect to their purpose.
